New law may cause drivers to be prosecuted for smoking cannabis DAYS before examination

Those who use the drug for even a week or more can still be prosecuted under the new proposed drug-driving legislation.

This is according to the Transport Minister Paschal Donohoe.

At present, drivers can only be prosecuted if their driving is impaired by use of the drug.

This new legislation would given Gardai permission to test motorist’s saliva by the roadside, followed by a blood test.

According to Minister Donohoe this will enable Gardai to test for many types and forms of drugs.

Drugs such as cannabis, heroin and cocaine will be tested for and each drug will have a specific limit.

A swab will be used to test drivers’ saliva and then if opiates are found Gardai can go ahead and do a further impairment test.

Penalties for failing a drugs test is a fine of up to €5,000 or six months in prison. As well as a driving disqualification.
