Welcome news as Court of Criminal Appeal overturns a ludicrous loophole that allowed drink drive offenders to escape prosecution




There was some good news regarding the upholding of drink driving offences as the Court of Criminal Appeal overturned a ludicrous loophole that allowed offenders to escape prosecution.

The court today thankfully reversed a ruling that stated all breathalyser tests statements must be printed in both Irish and English. The welcome decision will put a stop to people exploiting the system to escape punishment after the initial ruling held up around 1,400 alleged drink driving prosecutions.

The new ruling received the full support of Fianna Fáil’s Transport Spokesperson Timmy Dooley who labelled the decision as common-sense. Mr Dooley said: “I’m very pleased at the clarity provided by the Court of Appeal,” he said.

“I think it’s a good decision. I think it ensures that up to 1,400 people will not now evade justice on a ridiculous technicality.”

“There’s no doubt that drink-driving leads to death and horrendous injury on our roads, and there can be no hiding place for those who are caught in the act.”
