
A 46-yr-old man who submitted a fraudulent claim to the Motor Insurers Bureau of Ireland has never held employment and has 19 prior convictions, Dublin Circuit Criminal Court heard.
He’s been jailed for 3 years today.
Constantin Iosca, of Scholar’s Walk, Lusk, Co Dublin, alleged that he sustained serious injuries after being struck by a car while cycling in Lusk in 2016, reports RTE
However, he abandoned his case on the third day of proceedings in the High Court after video evidence was presented showing him carrying a wheelchair and walking unaided.
Ms Justice Patricia Ryan said she will impose sentence on the father of three and grandfather on Monday, reports RTE
Sergeant Aisling McLaren of the Garda National Economic Crime Bureau told the court today that she was assigned in March 2020 to investigate an alleged insurance fraud case.
Iosca alleged on 10 July 2016 that he suffered serious injuries to his back, arm and leg after being knocked from his bicycle by a car in Lusk on 1 June 2016, reports RTE
Insurance firm FBD engaged D4 Security to conduct surveillance on the 46-year-old, capturing footage of him walking unaided, carrying a wheelchair, placing it into a car boot, and later using the wheelchair and crutches while attending a medical appointment.
Iosca initiated High Court proceedings on 21 January 2020 but withdrew the claim three days later once the surveillance footage was shown, reports RTE
The 46-year-old was later arrested as part of the criminal inquiry but responded “no comment” when questioned by gardaÃ.
He was charged, entered a plea of not guilty, but was ultimately convicted of deception at Dublin Circuit Criminal Court on 14 November last, reports RTE
Iosca was born in Romania and moved to Ireland in 1997 at the age of 18, but his defence counsel told the court today that he has never worked due to a lack of employment experience.
Kieran Kelly informed the court that Iosca remains at home with his family and enjoys accompanying them on shopping trips, reports RTE
He also presented letters from Iosca’s partner of 30 years describing him as a caring and considerate person, and said he suffers from several health conditions including asthma, diabetes and high blood pressure, and is awaiting physiotherapy.
