
A boy who reportedly tripped on an astro turf pitch and broke his arm has settled a High Court case for €37,000, reports Breaking News.
Callum Whelan was just seven years old at the time of the incident, which occurred on a pitch owned by Dublin City Council.
His senior counsel, Michael Byrne SC, told the court that it was their position that Callum had been playing football when he fell after allegedly tripping on a hole in the astro turf surface, reports Breaking News.
Mr Byrne said liability in the matter had been fully disputed.
Callum Whelan, now 13 and living in Poppintree, Ballymun, Dublin, brought the case through his grandmother, Josephine McDonagh, against Dublin City Council, reports Breaking News.
The incident was said to have occurred on May 1st, 2019, while the boy was playing football on the astro turf pitch at Poppintree Astro in Ballymun.
The case alleged that a hazard had been created due to a failure to properly inspect or maintain the pitch. It was further claimed that there had been no reasonable steps taken to ensure the area was safe for children or members of the public, reports Breaking News.
Claims included the alleged lack of warning signs or cordons and a failure to routinely check and maintain the surface while allowing public access.
All allegations were denied by Dublin City Council, which argued that it had not caused the alleged defect, reports Breaking News.
Mr Byrne explained to the court that Callum had suffered a grossly displaced fracture in his upper right arm, requiring surgery. Several pins were inserted during treatment, but the boy has since fully recovered.
Mr Justice Paul Coffey approved the €37,000 settlement, stating it was fair and reasonable, reports Breaking News.
