Grieving father rejects a judge’s suggestion that the ashes of his dead child should split between him and mother




A devastated father has turned down a judge’s suggestion that he and his estranged partner, the kid’s mother, divide the ashes of his deceased small child, reports The Mirror.

Judge Alec Gabbett of the Family Law Court stated that the couple was having trouble because of the matter involving the ashes of their deceased child.

In court, the child’s mother, who was represented by attorney Shiofra Hassett, stated that her former boyfriend “always says he will move the ashes and take them away from me,” reports The Mirror.

“Is it possible for the two of ye to split the ashes?” enquired Judge Gabbett, reports The Mirror.

The father replied that he didn’t agree with that suggestion.

Judge Gabbett said: “Okay, that is fine, let’s park that.”

Judge Gabbett asked: “Is it possible that ye could inter the ashes somewhere and by agreement put them into a grave or somewhere ye could both visit? Is that in the plan?,” reports The Mirror.

Judge Gabbett said: “Ye need to finalise where your child is going to rest. This is a significant stressor – this needs to be resolved,” reports The Mirror.

Both parents cried at separate points throughout the intense hearing concerning the mother’s application for a Safety Order against her ex-partner.

The woman was under stress since the man kept the key to his ex-partner’s house.

Judge Gabbett asked: “Is it possible that you give the key of the house back if you get some items belonging to your child, though not the ashes as ye would try to reach agreement by mediation of where the child would rest ultimately,” reports The Mirror.

He said: “Otherwise I have to bar you from the house. I want you to stay away from the house because being in the house is no longer appropriate,” reports The Mirror.

Judge Gabbett said: “Ideally this lady would give you some memorabilia for your child – that is the best I can do.”

In court in November, the lady claimed that her ex-partner had been violent, aggressive, and controlling towards her, and she was successful in obtaining a domestic violence protection order against him on an ex-parte basis, reports The Mirror.
