Ireland’s Housing Crisis: Loophole that allows landlords to evict long-term tenants “without providing a reason” to be closed




According to the Examiner, Fianna Fail’s Housing Minister Darragh O’Brien is to close a loophole that allows landlords to arbitrarily evict long-term tenants without providing a reason.

As it stands, landlords who have a Part 4 tenant, which allows people stay in a property securely for up to six years, can be evicted without any reason given by the landlord.

According to the Irish Property Owners Association, a Part 4 tenancy is a tenant that resides in a property for more than 6 months. A Part 4 tenancy is either a 4-year cycle or a 6-year cycle dependant on when the tenancy commenced.

Any tenant who is a Part 4 tenant can be evicted without being given any reason by the landlord, after expiry of the tenancy agreement.

However, a loophole means that once a Part 4 tenancy expires, the landlord can terminate that tenancy without providing any reason.

It is understood, Minister for Housing, Mr O’Brien will address this loophole by requiring landlords to give a reason for the eviction.

Tenants in Ireland are asking why more isn’t being done by Government to give real security of tenure similar to the excellent protections that German renters have.
