A 31-yr-old man has been handed a six-year prison term for killing another man in an unprovoked single-punch assault close to his residence in Whitehall, Dublin, two and a half years ago, reports RTE.
Christopher O’Neill, from Larkhill Road in Dublin, admitted guilt at the Dublin Circuit Criminal Court to the manslaughter of 33-yr-old Martin Lynn on 30 July 2023, reports RTE.
Judge Martin Nolan called it a “pretty awful case” and remarked that it was difficult to comprehend why O’Neill carried out the act.
Mr Lynn had stepped out of a taxi after watching the film Oppenheimer with his girlfriend on 30 July 2023 and was standing on the pavement outside his home chatting with her.
A motorcyclist passed by, then returned, dismounted while still wearing his helmet and, without any apparent cause or provocation, struck Martin Lynn in the face, reports RTE.
Mr Lynn, whose hands were in his pockets, collapsed onto the ground on Larkhill Road, suffered fatal head injuries and passed away in hospital two days later.
It required several months and multiple appeals before Christopher O’Neill was identified.
He was detained in December 2023 but made no confessions and submitted his guilty plea to manslaughter at a late point. He has 24 prior convictions, reports RTE.
Martin Lynn had recently begun a new position at the Santry Sports Clinic at the time of his death and his sister Sharon, in a victim impact statement, portrayed him as a gentle and sensitive individual who never caused problems.
The family, she said, have been living a nightmare
His mother Sadie Lynn stated the family will never recover, and knowing it occurred right outside their front door makes it even more painful, reports RTE.
Judge Nolan noted it was clearly a very grave offence but it appeared Christopher O’Neill had no intention to kill Martin Lynn and he would aim to deliver a fair and balanced sentence.
He mentioned O’Neill had shown remorse and the judge labelled his behaviour as reckless before imposing a six-year prison sentence.
The 31-year-old smiled and winked at someone as the sentence was announced and showed aggression towards a person in the public gallery who told him to “wipe that stupid smile off your face” before being led away by prison officers from the courtroom, reports RTE.
Afterwards the Lynn family expressed they were deeply disappointed with what they saw as the leniency of the sentence.
Mr Lynn’s sister Sharon Lynn said O’Neill had never come forward, had only pleaded guilty at the last minute and had never expressed remorse to them.
She also said he had been before Judge Nolan for previous offences in 2012 and had been given a lenient sentence then but had gone on to commit further crimes including taking her brother’s life, reports RTE.
The family say they will ask the DPP to appeal the leniency of the sentence and have called for a mandatory minimum sentence to be introduced for one-punch attacks.
