
A healthcare worker has been awarded €37,000 in damages against the Minister of Expenditure and Reform after their car was struck by an unmarked garda car at high speed, reports RTE.
In July 2020, Celine Kavanagh was driving near Plunkett Green, Finglas, Dublin, when the garda car suddenly backed into the front of her vehicle. She reported this to Judge Jennifer O’Brien in the Circuit Civil Court.
She told her attorney, Grainne Berkery, “The incident was completely unexpected and I was extremely concerned for my mother who was crying in the passenger seat.”
When she realised the automobile that had hit her was an unmarked garda car, she herself had been severely startled, terrified, and traumatised, reports RTE.
Alongside Stuart Gilhooley from H J Ward Solicitors, Ms. Berkery said the court that Ms. Kavanagh, 55, of Cappagh Avenue, Finglas West, Dublin, had hurt her left shoulder and buttock and was so distressed that she had psychological problems that needed to be treated with treatment.
According to Ms. Kavanagh, she had turned into a worrisome person who got agitated quickly and was always expecting the worse, reports RTE.
She experienced flashbacks and was required to drive as part of her job as a home care provider.
The court heard that Ms. Kavanagh had developed an extreme sense of hazard aversion.
She started to have sleeplessness, disturbed sleep, and increased irritability and depression, reports RTE.
