In what could be one of the biggest overturns in Irish legal history, Graham Dwyer may eventually walk free from prison after his appeal case has seen a major lift today.
The top European Court has ruled that obtaining mobile data and metadata, which was used in his 2015 murder conviction, was illegal.
After his conviction, the accused was led away to begin his prison term, a victim impact statement by Ms. O’Hara’s father was read out by senior counsel for the prosecution Sean Guerin. The statement said that the O’Hara family are now serving a life sentence from which there is no parole.
But all that could now change as a result of today’s court ruling. It doesn’t necessarily mean his conviction will be overturned but it’s a big win for its chances today.
