The 15-yr-old began playing with a ball with another group when she and her pals were in the sea in Bournemouth, reports The Sun.
Gabriel Marinoaica, 24, scooped up the ball after it was booted away and struck up a conversation with the girl.
He then allegedly asked the girl if she wanted to “smash,” or have sex, after dragging her farther into the water than she could swim.
Jurors heard her tell him, “No, get off me,” yet Marinoaica bit her neck after groping and kissing her, reports The Sun.
The girl was then revealed at Bournemouth Crown Court that he had raped her after covering her lips with his hands to prevent her from screaming.
Ellie Fargin, prosecuting, said: “He took her out of her depth, he made her vulnerable, she couldn’t even swim, he might not have known that but he might have known she could not touch the bottom. And why did he do that? So he could do what he wanted to do. She didn’t consent and we say he knew that, he simply didn’t care,” reports The Sun.
The girl’s relatives called the police after she subsequently informed them what had transpired.
After around 11 months, Marinoaica was taken into custody after authorities discovered a match for his DNA on the purported victim’s bikini, reports The Sun.
