Aussie man charged with rape avoids jail after woman ‘suddenly remembers’ she consented to sex




Charges of rape against an Australian man have been dropped after his accuser remembered that she had consented to sex.

Justin Banham (49) was charged with raping the unnamed woman on October 8, 2017 after the two had a fight.

The charge was set to proceed to trial this week, but all charges have been dropped after the woman claimed she suddenly remembered that she had consented to sex with Mr Banham.

The Gold Coast Bulletin reported that Mr Banham and the female accuser had argued earlier that October day and later that evening she invited him to her home. The two had consensual sex but by morning time the woman had incredibly lost all memory of inviting him over or consenting to sex.

The pair had been having consensual sex for several years before the incident.

Crown prosecutor Matthew Hynes said the woman had a history of post-traumatic stress and personality disorders.

To spare the accusing woman having to face cross examination Mr Banham later pleaded guilty to common assault in relation to allegation that he had pushed the woman onto a couch.

Banham was given a $300 good behaviour bond for one year.
