Teacher Enoch Burke has been released from prison this afternoon, and claims that it is a trap that he’s been released – citing that the Judge knows full well that he will be back to Wilson Hospital school tomorrow morning.
Enoch Burke said that he will definitely be returning to the school tomorrow morning.
Enoch Burke has been released from Mountjoy Prison, following an order by a High Court judge.
Mr Burke has been incarcerated since late November for breaching a court order that prohibited him from trespassing at Wilson’s Hospital School in Co Westmeath, where he was employed as a teacher, reports RTE.
Last week, Mr Burke sought a temporary injunction against a disciplinary appeals body tasked with reviewing his dismissal from the school.
In a hearing this morning, Mr Justice Brian Cregan noted that Mr Burke had raised “substantive” and “credible” issues regarding the Disciplinary Appeals Panel (DAP), reports RTE.
The judge explained that Mr Burke’s release was being ordered “for one reason and one reason only, interest in the administration of justice” and to allow him time to prepare for his case against the DAP.
However, the release was conditional on Mr Burke not trespassing on school property. Should he violate this condition, the judge instructed that the school could return to the High Court the following day, and he would have “no hesitation in bringing him back to prison,” reports RTE.
Mr Burke has made it clear he intends to return to the school once released from prison.
He has been incarcerated for 550 days for contempt of court, related to a previous court order directing him not to attend Wilson’s Hospital School, where he was employed as a teacher, reports RTE.
Following the judge’s decision, Mr Burke stated he did not agree with the reasons given for his release.
Mr Justice Cregan dismissed Mr Burke’s objections, saying he was “somewhat hamstrung” in preparing for his case while still in prison.
During discussions on submission deadlines for affidavits, Mr Burke reiterated several times that he would go to Wilson’s Hospital School once released, stating: “If I am released from this court today, I will be at my workplace tomorrow,” reports RTE.
The court confirmed that Mr Burke would be released, but scheduled a mention of the case for Thursday to address whether Mr Burke attends the school.
Mr Burke then accused the court of performing an “outstanding U-turn” and hypocrisy for choosing to release him.
In response, Mr Justice Cregan remarked: “Mr Burke, your ability to shoot yourself in the foot is unparalleled, in my experience,” reports RTE.
