Father and son lose their court challenge over Covid travel fixed €2,000 penalty notices on their way travelling to Italy in 2021

A father and son attempted to contest €2,000 fixed penalty notices they were issued for allegedly flying to Dublin Airport in 2021 in violation of Covid restrictions, but their High Court case was unsuccessful, reports Breaking News.

On April 17, 2021, Nicolae and Florin Mazarache of Clondalkin, Dublin, were being detained at the airport by a garda as they were on their way to visit family in Spain.

Notices claiming they had “committed an offence of movement of persons” at a port or airport in violation of the 1947 Health Act (as modified) were subsequently sent to them, reports Breaking News.

There was a set payment of €2,000, and if it wasn’t made within 28 days, they would have to appear in District Court and risk a fine of up to €4,000, one month in jail, or both.

The Mazaraches, of Lealand Meadows, Clondalkin, Dublin, decided to pursue judicial review instead of paying the stipulated fine.

They asserted, among other things, that the fixed notices they received were blatantly unjust since they failed to identify or detail the specific act they were accused of committing, reports Breaking News.
