French Court rules Transgender woman cannot legally be child’s biological mother




A transgender woman cannot be officially registered as her daughter’s biological mother, France’s highest court has ruled in a controversial recent case.

According to France 24, a 51 year old transgender woman has been in a long legal battle to be officially registered as one of her six year old daughter’s two mothers. Born a male, she was legally recognised as a woman in France and conceived a child with her wife in 2014 as she still had male sex organs.

In 2018 a court in the southern city of Montpellier granted her the status of ‘biological mother’, but this was recently cancelled by higher legal officials in Paris who ruled that the woman would have to legally adopt the child to be legally recognised as her mother.

The woman’s legal team described the ruling as ‘scandalous’, and plan to take the case to the European Court of Human Rights.
