He’ll never call a girl a boy: Enoch Burke could end up back in prison as former school seeks order over his attendance

A Co Westmeath school has lodged a new application in the High Court which could see teacher Enoch Burke returned to prison for continuing to attend the school despite his dismissal.

Lawyers for Wilson’s Hospital School told the court this afternoon that they are seeking permission to inform Mr Burke of their intention to seek orders ordering him to be tried and detained for his offence, followed by a permanent restraining order Order instructing him to stay away from school premises, reports RTE.

Lawyer Rosemary Mallon told Judge Emily Egan that Mr Burke had attended school every day since the start of the new school year in late August, despite being suspended and eventually fired from his job as a German and history teacher.

Mr Burke claimed he was fired because of his Christian faith and opposition to “transgender”.

The school said he was fired because of his behavior and concerns about what his behavior would look like in the future.

Ms Mallon said Mr Burke’s presence “outside and inside the school” was a breach of an injunction granted by the Supreme Court earlier this year.

The court heard for much of the staff’s working day, the manager, Frank Milling, looked after Mr Burke.

She said Mr Milling occasionally had to close the doors to prevent Mr Burke from entering the school

Ms Mallon said the board had returned to the school “with great reluctance” an year after its first complaint against Mr Burke.

In August last year, Mr Burke failed to comply with a court order to stay home from school after being suspended as part of a disciplinary hearing.
