
The High Court has approved a settlement of €1.1 million in favour of a young man who sustained a serious brain injury in a road collision five years ago.
Cian Slevin was 16 years old when his head struck the ceiling of a vehicle in which he was travelling as a passenger, after it left the road and ended up in a stream in Tipperary in January 2021, reports RTE.
Senior Counsel Patrick Treacy told the court that Mr Slevin was not wearing a seatbelt at the time and suffered a head injury along with multiple spinal fractures.
Now aged 22 and from Ardfinnan, Co Tipperary, Mr Slevin had brought proceedings against the driver of the car, Feidhlim Ryder, aged 24, from Newcastle, Co Tipperary, in connection with the crash on 27 January 2021, reports RTE.
The proceedings alleged a failure to keep the vehicle on the road in a safe and appropriate manner, a failure to control the vehicle to avoid the collision, and that the car had been travelling at excessive speed.
All of the claims were denied, and the settlement was reached following mediation. The court was told the respondents did not accept that the degree of cognitive impairment was to the extent alleged. Mr Treacy told the court there was a “vulnerability in the case,” reports RTE.
Approving the settlement, Mr Justice Paul Coffey said it was fair and reasonable, reports RTE.
