
The owner of a hotel in Wicklow asserts that because its present operator is unwilling to relinquish unoccupied possession, the hotel might lose up to €2.1 million for accepting applications for international protection, reports Breaking News.
MBE Investments Ltd. filed a lawsuit in High Court against Vesta Hotels Ltd., the company that runs Wicklow town’s Grand Hotel on Marlton Road.
MBE leased it to Vesta in September 2017, and Vesta’s registered address is Fumbally Court, Dublin 8. The hotel had a nightclub, a restaurant, two meeting rooms, and thirty-five guestrooms, reports Breaking News.
MBE is requesting orders and declarations stating, among other things, that Vesta has been trespassing on the land since October 1st and that a leasing agreement terminated on August 19. In addition, it demands damages for contract violations and losses brought on by the claimed trespass.
Two years after the lease was signed, its terms were varied, and it was noted that Vesta had been using the hotel to provide services to the Department of Justice Reception and Integration Agency (DoJRIA) since December 2018, according to an affidavit filed by MBE director Seán Tobin, who is requesting that the case be entered into the Commercial Court, reports Breaking News.
In August 2022, the lease was again extended for an additional two years.
According to Mr. Tobin, Vesta also executed a document of renunciation giving up any claim to an extended lease.
MBE questioned Vesta in the middle of 2023 about its plans for August 2023, when the lease was set to expire. Mr. Tobin stated that Adrian Shanagher, a director of Vesta, “indicated that he had no interest in extending the lease” during a meeting in October 2023, reports Breaking News.
According to Mr. Tobin, MBE wrote to Vesta in May of last year requesting that the property be turned over since the lease was about to end in August. However, MBE did not receive a meaningful answer.
Meanwhile, MBE maintained communication with a company that manages International Protection Accommodation Service (IPAS) facilities, and after deliberations, MBE and Templegrade ULC last June came to a basic understanding, reports Breaking News.
