Nanny State? McEntee proposes laws for gardai to tackle cyber crime




In order to assist gardaí in combating cybercrime, Minister of Justice Helen McEntee will get Cabinet permission before drafting new laws, reports RTE.

Digital criminal evidence will be easily accessible to gardaí according to the Criminal Justice (Protection, Preservation and Access to Data on Information Systems) Bill 2024.

Conventional search and seizure rules date back before the new technology advancements and focus on tangible locations and items, reports RTE.

This new Bill will ensure that people’s privacy rights are maintained while enabling gardaí to conveniently access internet evidence, given the quantity of criminal activity that is now occurring in virtual space.

As per the law, internet service providers can get preservation and production orders from gardaí.

This will compel them to create and maintain digital evidance, reports RTE.
