Standing his ground – Court hears Attorney General has standing to seek a sequestration of Enoch Burke’s assets

The High Court has heard that the Attorney General feels he has the right to attempt to sequester the assets of teacher Enoch Burke, who is allegedly violating a court order by returning to his former workplace, reports Breaking News.

Since the Attorney General would have standing “in the public interest,” Rossa Fanning’s attorneys stated that they saw nothing improper with his serving as the moving party in this type of action, which is related to fines of almost €190,000.

But according to Brian Kennedy SC, the more traditional course of action would be for St. Wilson’s Hospital School, the initial court petitioner, to request sequestration, reports Breaking News.

He noted that another way to enforce the court fines is by a garnishee order, which entails bringing the accused debtor before the court.

Mr. Justice David Nolan asked Mr. Kennedy exploratory questions on Tuesday in order to determine what procedures may be utilised to collect penalties from Mr. Burke for each day he attended St. Wilson’s Hospital School in violation of a court order, reports Breaking News.

The judge requested that the Attorney General and the Minister of Finance submit to the court. Mr. Kennedy also represented the Minister of Education, who the court heard is in charge of continuing to pay Mr. Burke’s teacher salary until the outcome of his appeal against his dismissal.

When the Co Westmeath school was closed for the holidays, Mr. Burke was freed from prison before to Christmas. Because he disregarded a court order to leave the grounds, he was imprisoned at Mountjoy for more than 500 days, reports Breaking News.

The teacher of history and German returned to the school when it reopened on January 6th, and has been present on the majority of working days since, the court heard on Tuesday.

Mr Burke wrote to reiterate his claim that the courts had denied him his fundamental rights to freedom of conscience and the free profession and practise of religion, but he did not show up in court on Tuesday afternoon, reports Breaking News.

“I understand that the High Court is seeking advice today from the Attorney General and the Minister for Finance to strip me of my livelihood,” the judge read out from his letter in court. This is unheard of, unlawful, and unsettling, reports Breaking News.

He says he was put in jail for upholding his Christian faith by opposing “transgenderism” and refusing to refer to students using the pronouns “they/them.”

According to the school’s senior attorney, Alex White, Mr. Burke was present at the school when the court convened on Tuesday. According to Mr White, Mr Burke has occasionally visited the school’s grounds but not the actual structure, reports Breaking News.

While some “unknown third parties” who seem to be supporting Mr. Burke have occasionally arrived, Mr. White said that the ongoing participation has created disturbance.

The lawyer informed the court that his client would not request that Mr. Burke be attached and sent to prison for attending the school.

Regarding the possible sequestration of Mr. Burke’s assets due to penalties levied by the court for each day he attended the school in violation of a court order, Mr. White stated that he agreed with the arguments raised, reports Breaking News.

“All the school wants to do is to be a school,” he added, adding that the issue had persisted for years.

Mr. Justice Nolan stated that he thinks the €700 daily fines that his colleague, Mr. Justice Brian O’Moore, had initially ordered in early 2023, stopped being applicable in the middle of the year, when additional orders were issued after a lengthy hearing of the matter.

For every day that Mr. Burke refuses to get rid of his disdain, he earlier stated that he was considering doubling the daily punishment to €1,400, reports Breaking News.
