Taoiseach must hand in his formal resignation if he does not gain majority support, says former Attorney General Rodgers

The Taoiseach Enda Kenny must formally hand in his resignation if he fails to get majority support in the Dail later this week a leading constitutional lawyer has said.

The statement which has come from former Attorney General John Rodgers who believes Mr Kenny’s position as leader is under threat. Mr Rodgers also said there was a precedent set in 1989 when the then Taoiseach Charles Haughey was forced to resign, but stayed on as caretaker Taoiseach until a Government was formed.

The news comes as the Dail will vote this coming Thursday when Mr Kenny, Micheál Martin and Gerry Adams all put their names forward to become the next Taoiseach.

Mr Rogers told reporters: “Mr Haughey did resign, so far as I remember it, and that resolved the issue and I think that is the appropriate way it should be resolved. “My view is that it is a very important signal that the Constitution is effective, that that would happen.

“And I think that’s what should happen, if Enda Kenny doesn’t secure the support of the majority of Dáil Eireann.”

It is widely expected that that none of the above mentioned political leaders will gain enough support to become Taoiseach which will leave the country in the hands of a caretaker government until the issue is resolved.
