Woman launches legal challenge after she claims abortion clinic failed to inform her that her baby could feel pain before the procedure took place

A woman in the UK has launched a legal complaint against an abortion clinic after they failed to tell her that her baby could feel pain before it was aborted.

Ana-Maria Tudor claims that the abortion provider, BPAS abortion clinic in Richmond, did not inform her that her baby could suffer during the abortion which she went through when she was 23-weeks pregnant.

According to Spuc news, Ms Tudor claims that the failure of the abortion provider to inform her that her unborn baby would suffer during its death means that they did not have her full informed consent.

“I did not find out that a baby at 23 weeks might be able to feel pain until afterwards. It made me feel awful and now I deeply regret my decision.”

Ms Tudor said.

Legal representatives, Sinclairslaw, have sent a letter to the National Institute for Health and Care Excellence (NICE) challenging their guidelines on abortion.

It has long been established that unborn babies can feel pain from 20 weeks gestation but a recent research ‘Reconsidering Foetal Pain’, published in the Journal of Medical Ethics, indicates that unborn children may be able to feel painful sensations as early as 13 weeks.

In Ireland, after the legalisation of abortion on demand up to 12 weeks and up to birth under the broad and vague definition of fatal foetal abnormality of danger to the woman, the government with the support of much of the opposition defeated a bill requiring pain relief for unborn babies before they are killed.
