35-yr-old man jailed for assaulting garda on Christmas night out




An individual with a long history of substance abuse has been sentenced to three years and three months in prison for assaulting a garda during a Christmas night out, reports RTE.

Jonathan O’Neill, aged 35 and of no fixed address, pleaded guilty at Dublin Circuit Criminal Court to one count of assault causing harm to Stephen Walsh, aged 50, at Eustace Street in Temple Bar on 14 December 2024, reports RTE.

Garda Walsh and his colleague Paul McCauley were off duty and walking through the city centre on their way to catch a bus when they were attacked by two men.

O’Neill has 37 previous convictions, including offences such as robbery and criminal damage, reports RTE.

Judge Orla Crowe imposed a sentence of three years and nine months, suspending the final six months under strict conditions.

“This was a horrific attack on two men who were going home from a night out for Christmas,” said the judge, reports RTE.

Detective Sergeant Patrick Traynor told the court that Garda Walsh and Garda McCauley had been heading for a bus after a Christmas night out in the early hours of the morning.

The court heard that neither injured garda has any recollection of the incident, which occurred at around 1.30am, reports RTE.

It was stated that O’Neill’s co-accused struck Garda McCauley, causing him to hit his head on the kerb and lose consciousness immediately.

O’Neill punched Garda Walsh in the back of the head, while the co-accused kicked him as he lay on the ground. Garda Walsh was also knocked unconscious, and “his colleague was in quite a dire situation”, the court was told, reports RTE.

O’Neill and the other man then fled the scene.

Garda Walsh recalled regaining consciousness and tasting blood, while two reserve gardaí arrived as Garda McCauley remained unconscious. Both men were taken to hospital, reports RTE.

Garda McCauley fell into a coma due to injuries attributed to the co-accused, while Garda Walsh was found to have fluid leaking from his nose, later identified as spinal fluid, and now suffers hearing difficulties requiring ongoing treatment.

Det Sgt Traynor agreed with prosecuting counsel Patrick McCullough that the investigation was extensive and involved reviewing CCTV footage. Upon arrest, O’Neill said: “I knew this was coming”, the court heard, reports RTE.

He admitted being present and said he was unsure whether he delivered a push or a punch, while expressing some concern. His role related to striking Garda Walsh to the back of the head, and it was acknowledged he has longstanding substance abuse issues.

‘Those thoughts haunted me’

Garda Walsh delivered a victim impact statement in which he said he feared his colleague might not survive. “Those thoughts haunted me” he said.

He explained that he can no longer carry out normal duties, has undergone hearing assessments, and suffers some permanent hearing loss, saying it has “affected me in my everyday activities and possibly my career as well, reports RTE.

The prosecution accepted that the most serious injuries were caused by the co-accused’s kick.

Defence counsel Michael O’Higgins said his client had originally faced a more serious charge but pleaded guilty to a lesser offence.

He said O’Neill had written a letter of apology stating the incident “all happened so fast”.

“I’m writing this letter in the hope you’ll accept my apology.”

He said he was “so sorry I put you and your family through all this, especially at that time of year, reports RTE.

Judge Crowe said the offence warranted a prison sentence.

“That punch got the injured party to the ground” which led to more serious injuries inflicted by the co-accused, she said.

The judge added that it was an unprovoked attack on the men, who “did no more than go out for a few drinks at Christmas time”.
