
Teacher Enoch Burke has resumed his duties at a secondary school in County Westmeath, even though he was unsuccessful in his High Court case to overturn a ban, reports RTE.
He arrived at Multyfarnham’s Wilson’s Hospital School, which was available for first-year students to attend an orientation morning.
Mr. Burke lost a High Court case this month that sought to revoke the May 2023 injunction prohibiting him from entering Wilson’s Hospital School.
After being imprisoned for contempt of court in September of last year, Mr. Burke was released from prison in June, reports RTE.
After the school let out for the summer, an order was issued for his release.
He had contested the initial ruling from Mr. Justice Alex Owens in May 2023, which had given Wilson’s Hospital a perpetual injunction barring Mr. Burke from going to the school.
The judge stated in a July ruling that the only matter on the table was whether the court had the authority to consider Mr. Burke’s request to have Judge Owens’ ruling set aside, reports RTE.
He stated that Burke’s request “fell so far short of the ‘truly exceptional’ circumstances in which the court might entertain an application to set aside a final order” .
The court dismissed the case and stated that the school will be reimbursed for its expenses. However, he would first take written comments on the costs before making any final decisions, reports RTE.
