Dublin woman loses €60,000 claim over eyebrow waxing damages




A Dublin lady’s €60,000 damages suit against the salon owners was unsuccessful. The woman claimed she had yelled in agony when a beauty therapist “suddenly and ferociously” pushed a wax strip down her right eyebrow, reports RTE.

Nikita Kelly was just 17 years old when the alleged event occurred, according to Judge James McCourt, who dismissed her case on the grounds that she had concealed a skin condition from the public that had been disclosed in court-filed medical records.

“People have to work with people and professionals cannot be expected to divine information that should be freely forthcoming from a patient,” Judge McCourt said, reports RTE.

Ms. Kelly, who turns 25 on Tuesday, informed the court that she suffered skin peeling and red spots on her right eyebrow, nose, and forehead after getting her eyebrows waxed at the AP Fashion Nails beauty shop in Finglas, Dublin 11.

Ms. Kelly admitted during cross-examination that she had received prescriptions from her doctor to address face skin issues, but she had not taken any of the medicine when barrister Helen McCarthy, attorney for Amie Pike and Thomas Heary, the proprietors of AP Fashion Nails, questioned her, reports RTE.

Ms. McCarthy told the court that it was evident from medical documents that Ms. Kelly had been prescribed medicine for acne and dry skin issues as a teenager. Ms. McCarthy appeared in court with Kerry Lyons of Ennis Solicitors on behalf of the beauty shop and its insurance Aviva.

“I put it to you that you haven’t been very truthful here today,” Ms McCarthy told Ms Kelly, reports RTE.
