Enoch Burke’s father tells the court that he doesn’t remember throwing female garda to the ground

In the Court of Appeal (CoA), the father of teacher Enoch Burke, who is now in jail, told a court that he does not remember tossing a female garda to the ground and suggested that it was “completely accidental” if it did occur, reports Breaking News.

In the Four Courts on March 7th of last year, Sean Burke, who is in his 60s, denies assaulting Garda Victoria Fisher.

Ammi Burke, his 33-year-old daughter and a licensed attorney, enters a not guilty plea to hindering a garda who detained her brother Simeon Burke, 25, outside the premises on the same day.

The arrests took place after Enoch Burke was fired by Wilson’s Hospital School in County Westmeath and was embroiled in a legal battle before the CoA on transgenderism, reports Breaking News.

After hearing testimony from eleven Garda witnesses, Sean and Ammi Burke were convicted guilty on May 9th of this year at Dublin District Court.

In the instance of Sean Burke, the District Court avoided a recorded conviction by applying the Probation of Offenders Act. Ammi Burke, however, was found guilty and ordered to turn over €400 within a year, reports Breaking News.

The verdict, which took place over two days last month before Judge Ronan Munro, was appealed by them. The hearing at Dublin’s Cloverhill Court went on all day and into Monday night. Judge Munro informed the Burkes that his decision will be delivered on December 17.

He learnt that the Court of Appeals had issued a decision informing Enoch Burke that the school’s action against him was not about transgenderism, reports Breaking News.

He pointed out from the hearing’s audio recording that the court stood twice and that the three CoA judges got up to leave the bench when the Burkes interrupted them or yelled at them.

In addition to warning them to keep quiet or face removal and return, Mr. Justice George Birmingham also stated that the judgement would be delivered electronically if there were any further interruptions, reports Breaking News.

According to Judge Munro, Mr. Justice Birmingham cautioned them around ten times, and the Burkes remained in court after the justices departed the second time.

Before removing their mother, Martina Burke, the Gardai first took Ammi Burke and then Simeon, who was clinging to seats, reports Breaking News.
