Big blow for #MeToo movement after New York court overturns Weinstein sexual assault, rape conviction

The highest court in New York has reversed the disgraced film producer Harvey Weinstein’s 2020 conviction for sexual assault and rape, reviving the historic case that started the #MeToo movement, reports RTE.

The state’s Court of Appeals ruled in a sharply divided 4-3 ruling that the trial judge erred significantly in permitting women to testify that Weinstein had assaulted them, despite the fact that their claims were unrelated to the charges against him.

The verdict stated that the judge made matters worse by permitting Weinstein to be cross-examined about a wide variety of “loathsome” behavior, such as bullying and outbursts at colleagues, which painted him in a “highly prejudicial” manner.

“It is an abuse of judicial discretion to permit untested allegations of nothing more than bad behavior that destroys a defendant’s character but sheds no light on their credibility as related to the criminal charges,” Judge Jenny Rivera wrote for the majority, reports RTE.

“The remedy for these egregious errors is a new trial,” she added, reports RTE.

Weinstein has been incarcerated in a New York prison for 23 years.
