Big win for Donald Trump as Judge dismisses classified documents case against him

As part of his bid to win back the White House, former President Donald Trump has secured another significant legal win when a US court dropped the criminal prosecution accusing him of improperly retaining confidential data, reports RTE.

Mr. Trump’s nominee, Florida-based US District Judge Aileen Cannon, decided that the prosecution’s chief, Special Counsel Jack Smith, was not authorised to file the case and was improperly appointed to his position.

After the US Supreme Court ruled on July 1 that Mr. Trump was immune from prosecution for many of his acts while in office, this was yet another historic legal success for the businessman, reports RTE.

It is anticipated that the prosecution will appeal the decision.

In other situations, courts have affirmed the US Justice Department’s authority to designate special counsels to oversee some politically sensitive investigations.

Judge Cannon’s decision, however, casts uncertainty on the case’s future, since it previously presented Mr. Trump with significant legal risk, reports RTE.

In federal court in Washington, Mr. Smith is also pursuing Mr. Trump for his efforts to rig the 2020 election; however, in that case, Mr. Smith’s attorneys have not filed a comparable objection with the special counsel.

Mr. Trump was indicted in the papers case on allegations that he purposefully kept private national security materials at his Mar-a-Lago social club after leaving office and hindered government efforts to get them, reports RTE.
