Girl who was run over by a car when she was playing on a footpath settles High Court action




A girl who was run over by a car while playing on a footpath has settled a High Court action for €55,000, reports Breaking News.

Sunaminta Munteanu Covaciu was just five years old when the incident occurred in Balbriggan, Co Dublin, eight years ago, reports Breaking News.

Her barrister told the High Court that the car mounted the footpath and drove over the child while she was playing with a doll, trapping her underneath, reports Breaking News.

He said it was “miraculous” that she only sustained soft tissue injuries, bruising and some scarring.

The accident happened at Glebe Crescent on 29 May 2018 while the driver was parking the vehicle, reports Breaking News.

Sunamita Munteanu Covaciu, now 13, brought the case through her father against the driver and owner of the vehicle, with an address care of AXA Insurance in Dublin, reports Breaking News.

It was alleged in the proceedings that the vehicle was driven onto the footpath and that the manoeuvre was carried out when it was unsafe to do so, reports Breaking News.

The claim also stated there was a failure to keep a proper lookout and to control the vehicle at a safe speed to avoid the collision.

Liability was admitted in the case, reports Breaking News.

Counsel told the court that the child suffered anxiety, nightmares and a fear of crossing the road in the aftermath of the incident.

Approving the settlement, Judge Paul Coffey said it was fair and reasonable.

He added that he was pleased the girl had made a full recovery and wished her well for the future, reports Breaking News.
